Sec[Section] 1. Be it enacted by the people of the State of Illinois represented in the General Assembly
That the School Commissioner of Cook County be and he is hereby authorized and required to pay to the School Commissioners of
Cook County of the Counties of Will, McHenry, Lake and dupage respectively, or to such other person or persons, as shall be authorized by the county
Commissioners courts of each of said counties for that purpose out of the monies received,
or to be received by him in the Year 1840, from the interest on the school[,] College[,] and Seminary funds for the Year 1839 the following sums of money to wit,
To the School Commissioner of Will County or other person authorized to receive the same the sum of five hun[dr]ed Dollars. To the School Commissioner of Lake County, or such other person as shall be authorized to receive the same the sum of two hundred
Dollars. To the School Commissioner of McHenry County or such other person as shall be authorized to receive the same the sum of two hundred
Dollars. And to the School Commissioners of Du Page county or such other person as shall be authorized to receive the same the sum of two hundred
Dollars, Said money to be applied towards the support of schools in each of said
Counties, as by law like funds are now required to be paid, and which

said sums of money when paid shall be in full for any moneys heretofore due to the
aforesaid Counties on account of the aforesaid funds,
Sec 2. That the money specified in the foregoing section shall be paid over by the School
Commissioner of Cook county as soon as the same shall be demanded by ^of^ him, if the same shall have been received by him, and if said monies shall not have
been received by said school Commissioner of Cook county when demand shall have been made on him for the payment thereof as contemplated by
this act, then the same shall be paid over as soon as received by said School Commissioner
and payment thereof required, and no disbursement shall be made by the said School
Commissioner of Cook county, of any of the monies received or to be received by him, from or on account of the
School, College[,] and Seminary fund for the Year 1839 until after the several sums required by this
act to be paid as aforesaid shall be first taken out of the whole amount received.
Sec 3. That if the School Commissioner of Cook County shall neglect or refuse to pay over the said several sums of money by this act required
to be paid when the same shall be demanded of him, if said money shall have been received
by him, he

shall be liable together with his securities either jointly or severally, to be prosecuted
in an action or actions of debt, in the name or names of the School Commissioners
of the proper County, for the use of the the inhabitants of such county for such amount as shall be due and payable by virtue
of this act together with interest thereon at the value ^rate^ of ten per centum per annum, and costs of suit.
Sec 4. The School Commissioner of Macon County shall, in apportioning the School fund receivable by said . . . include that part of DeWitt form[?] constituting a part of Macon Coun[ty]

1Joseph Naper introduced HB 107 in the House of Representatives on January 7, 1840. The House referred the bill to a select committee. The select
committee reported back the bill on January 13 with an amendment, in which the House
concurred. The House passed the bill as amended on January 27. The House reported
the bill’s passage to the Senate, but the latter took no action.
