Sec[Section] 1 Be it enacted by the people of the State of Illinois, represented in the General Assembly, That William Smith and John Dinsmoor are hereby permitted to erect and establish a flouring grist and saw mills on Big Sandy Creek in Scott county, on the north west half of the North east quarter of section twenty four in township thirteen north of range thirteen west of the third principal meridian. And said Smith and Dinsmoor may erect the dam for said mill eight feet in height Provided, that if said dam shall cause the land to be overflowed belonging to any other person or persons, then said proprietors shall pay to such person or persons the amount of Damages which they shall sustain by reason of the erection of said dam.

Sec. 2. No person or persons shall, for the space of two years from the passage of this act, erect or build any dam or other mill on said stream so as to interfere with the rights and privileges of said Smith and Dinsmoor. This act to be inforce from and after its passage.

1On December 26, 1839, William Gilham in the House of Representatives presented a petition for a mill-dam on Big Sandy Creek. The House referred the petition to a select committee. In response to this petition, Gilham from the aforesaid select committee introduced HB 142 in the House on January 15, 1840. The House passed the bill on January 27. The House informed the Senate of the bill’s passage, but the latter took no action.
