Sect[Section] 1st
Be it Enacted by the People of the state of Illinois represented in the General Assembly that, the state Bank of Illinois and the Bank of Illinois or either of them be and they or either of them are herebyauthorised to demand and receive the following rates of intrest on [...?] any Loan not exceeding ^the term of ^sixty days Eight per cent per anum and Loans for any term not less than sixty days nor more than twelve months ten percent per anum
Section Second before either Bank shall be entitled to increase their rate of intrest the President and Board of Directors of each or Either Bank shall severly pass an order of the Board accepting the conditions of this act and make record thereof and furnish one coppy thereof to the governor and one coppy to the auditor of Public accounts who shall preserve the same and make record thereof.
Section third [...?] the conditions of this act [...?] per cent on [...?] go and draft so as not to expect one per cent
Section fourth third provided however that the ^Bank or^ Banks accepting shall pay to the State one and ^one half^ percent on all Loans hereafter made, at any place within the united states where it shall be by Law directed, and at any time when said Bank shall be indepted to ^the^ State to the amount of One Hundred thousand dollars provided however that said Bank devidends shall not be applied to any other purpose then the payment of the principle, or interest on the indeptedness of the state growing out of loans made by the fund commission for prosecuting a systim of Internal improvements nor for that purpose so long as the state be indepted to the Bank and said Bank dividends shall alwas be taken by the Bank in payment of state indeptedness

Section fourth the Bank or Banks, shall not be required to pay said ^dividends^ out of the state, unless they are received at par, provided further that the notes of either Bank shall at all time be received at par by the state, in payment of said dividends due by each ^Bank^ to the State; provided that said Bank or Banks shall make no charge against the state for making payments out of the state, but shall do it free of charge

1Andrew McCormick introduced HB 216 in the House of Representatives on January 21, 1840. The House referred the bill to a select committee. The select committee reported back the bill on February 3 without amendment, and the House took no further action.
