AN ACT to authorrze Benjamin W. Pope and William Gasoway to build a mill-dam.

Sec.[Section] 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That Benjamin W. Pope and William Gasoway be, and they are hereby authorised to raise and continue a mill dam across Big Muddy, on section, number twenty, township number seven, range number two east of the third principal meridiam, in the county of Franklin, to the height of ten feet: Provided, The said Benjamin W. Pope and William Gassoway own the land on which the same is to be raised; and, Provided, That the raising of said dam does not interfere with any mill dam formerly built across said river; however, upon the following conditions, to wit, That the State in no event, shall be bound to pay any damages for removing said dam, and other obstructions, shall it hereafter be necessary, for the purposes of improving the navigation of said river.

1On December 17, 1839, Representative Willis Allen introduced HB 24 in the House of Representatives. On December 23, the House passed the bill. On December 30, the Senate referred the bill to the Committee on Internal Navigation. On December 31, the Committee on Internal Navigation reported in favor of the bill with an amendment, and the Senate concurred in the amendment. On January 4, 1840, the Senate passed the bill. On January 9, the House concurred in the Senate’s amended version of the bill. On January 18, the Council of Revision approved the bill and the act became law.
