AN ACT to amend “An act concerning attachments,” approved, February 12th, 1833.

How far attachment law shall extend
Sec.[Section] 1. Be it enacted by the people of the State of Illinois, represented in the General Assembly, That all the provisions of the act entitled “An act concerning attachments,”2 shall extend to one or more joint debtors, so that in all cases, when two or more persons are jointly indebted, either as joint obligors, partners, or otherwise, and an affidavit shall be made in pursuance of the provisions of said act, so as to bring one or more of such joint debtors within the provisions of the same, and amenable to the process of attachment, then the writ of attachment shall issue against the property and effects of such joint debtors, so amenable as aforesaid, and shall direct the sheriff to summons all of the said joint debtors to answer to said action.
Sec. 2. The court out of which such writ shall be issued, shall proceed in relation to such joint debtors, and so much of their lands, rights, credits, money and effects, as may be attached in the same manner as pointed out in the act to which this is amendatory.

1On December 28, 1839, Orville H. Browning introduced SB 43 in the Senate, and the Senate referred the bill to the Committee on the Judiciary. On January 3, 1840, the committee reported the bill with an amendment, and the Senate concurred in the amendment. On January 7, the Senate passed the bill. On January 9, the House of Representatives referred the bill to the Committee on the Judiciary. On January 15, the committee reported the bill without amendment. On January 30, the House passed the bill. On January 31, the Council of Revision approved the bill and the act became law.
