A Bill for an act to create the County ofRadiation from the southern extremes of Pope and Johnson Counties and for other purposes
1Sec.[Section] 1. Be it enacted by the People of the State of Illinois represented in the General Assembly.
That all that part of the now Counties of Pope and Johnson lying within the following boundaries to wit:
Beginning at the Ohio River on the south side of Pope County in township sixteen south where the range line dividing between ranges six and seven
east, terminates
Thence north on said line to the south east corner of Section 25 township 15 range
Six east thence west one mile thence north one mile thence west 2 miles thence north
2 miles thence west 2 miles thence north 2 miles thence west 2 miles thence north
2 miles

thence west 2 miles thence north 2 miles thence west 3 miles to the Johnson & Pope County line thence west into Johnson County 3 miles thence south one mile thence west with the section line dividing township
14 though the centre to the west side of Johnson county thence south on the county line to the Ohio River thence up the Ohio River to the place of begining
Shall be created into a new County to be called the County of “Radiation”2
Provided That a majority of the legal voters of the present Counties of Johnson & Pope shall first vote seperately and distinct from each other at the election to be held in said counties on the first
Monday in August next And to afford an opportunity for such expession of opinion it shall be the duty of the propper officers of the now Counties of Johnson & Pope in preparing Poll-Books for Said August election to rule 2 Colums one for and the other against such division in which the votes shall be recorded
as given

for or against as the case may be3And if it shall appear from the returns of Said election that a majority of the qualified
Voters of said Counties of Johnson & Pope as now organised shall be in favour of the establishment of the new County of Radiation as above defined the fact shall be so certified by the Clerks of the County Commissioners Courts under the seal of their Offices in each of the aforesaid Counties which shall be
forwarded to the secretary of State at the seat of Goverment. and the said County of Radiation therefore be Considered and taken to be permanently and legally established with
the aforesaid boundaries
Provided also
That the proprietors and owners of Metropolis City in the aforesaid district proposed to be stricken of shall within twenty ^days^ after the next August election in the event of a majority being in favour of creating said new County Enter into a bond with good security to pay over to the County Commissioners of Johnson County within two years from and after the Confirmation of this act 1000 Dollars

in order to aid in erecting a new Court House at Vienna the present County seat of Johnson County. The said sum of 1000 Dollars is hereby required in Lieu of the territory stricken
of from the South Side of Johnson County and which sum shall be deemed the full and true proportion that ^would^ nessecarily have been paid by the Citizens of the said district: If said division had not taken
place
Sec. 2nd
The seat of Justice for the said New County of Radiation shall be located and permanently Established at Metropolis City on the most elevated Central and Elligable Situation:

Sec 3rd
The legal voters of the Said County of Radiation Shall meet at the respective places of holding e elections the third Monday in August next and proceed to elect all County officers
except Justices of the peace and constables (who shall hold their offices until their
time of election shall expire) and returns of said election shall be made by the Judges
and clerks to the Justices of the within said County Said Justices or any 3 of them Shall meet at Metropolis City within 10 days after Said Election and proceed to open the returns and in all things
perform the duties required by law of the clerks of Commissioners Courts, and Justices of the Peace in like Cases

Sec 4 That the County Commissioners Elected under this act shall meet at Metropolis City within twenty days after their election and being first duly qualified shall proceed
to appoint a clerk and lay of the County into Justices districts and all officers elected under the provisions of this act
shall be commissioned and qualified as required by law & shall hold there offices
unitil the next general Election and until their successors are qualified
Sec. 5
The Courts of Said County shall be held at such place as the County Commissioners shall designate until a suitable
preparation can be made at the County Seat.
Said County shall Constitute a part of the third Judicial Circuit and the Circuit Court shall be held for said County twice in each year at such time as the Judge of the said Circuit may designate

Sec. 6.
The qualified voters of the County of Radiation in all election except County elections shall vote with the Counties of Pope & Johnson and make returns to the Clerks of the County Commissioners Courts of the said Counties in the same manner as if no division had taken place until otherwise
provided for by law
Sec. 7 The inhabitants residing within so much of the territory set off and forming
a portion of Radiation County as are now within the bounds of Pope and Johnson Counties shall continue to be and constitute a part of the taxable inhabitants of
Pope and Johnson Counties until the 1st of January 1842

Sec. 8 The commissioners appointed by this act shall Proceed to lay of the Land donated to the said County of Radiation into Lots & streets Corresponding with those already laid out [in?] in Metropolis City after having first laid of a square for the Public buildings. and shall proceed to
sell said lots by giving at least 2 months notice previous to making such sale and
for each and every day they may be employed in makeing the said Survey Survey & Location they shall be paid the sum of two Dollars per day out of out of the County Treasury

Sec. 9
The County and Township school funds of the Counties of Johnson & Pope together with the interest ariseing out of said moneys that have not heretofore been expended for schools embraced within
the limits now proposed to be set of into the County of Radiation and all notes and mortgages appertaining to the same. whether County or township
funds shall be paid and delivered over to the school Commissioners of said County
of Radiation by the School Commissioner of the Counties of Johnson and Pope as soon as said County shall be organised. which funds shall be disposed of agreeably to the Laws regulating the same by the
school commissioner who shall be appointed and qualified according to law
Sec. 10
In Case any of the County officers of Johnson or Pope counties shall be included in the County of Radiation now proposed to be set of An4 ellection shall be held in either of the said Counties to fill the vacancy thereby created.
And all officers within the district set of shall continue to hold the same untill the successors shall be appointed and qualified

The County of Radiation shall be entitled to its distributive share of the funds received by the Counties
of Johnson & Pope according to the provisions of the Internal Improvement Law of this State5 and it is hereby made the duty of the County Commissioners Courts of the Said Counties of Pope & Johnson to pay over to the County Commissioners of the County of Radiation. Within 12 months after the passage of this act such distributive share as the Said
new County may be entitled to receive acording to the provisions of this section which distributive share shall be received in notes[,] Mortgages[,] or actual cash as the case may be
Sec. 12
The Citizens of the County hereby Created are entitled in all respects to the same rights and privilages as are allowed in general to all other counties of this state

2Between statehood in 1818 and 1867, the Illinois General Assembly authorized the creation
of 104 Illinois counties. During Lincoln’s four terms in the Illinois House of Representatives,
the General Assembly authorized 38 counties. Although the Twelfth General Assembly
did not approve this bill regarding Radiation County, the Thirteenth General Assembly
two years later approved the formation of Massac County with generally the same boundaries here proposed for Radiation County.

or reject the creation of the new county in only twelve of the 38 counties authorized
between 1834 and 1842. In four instances, a majority of voters rejected the creation
of the new county. The Illinois Constitution of 1848 made such referenda mandatory

5In section eighteen, sub-section fifteen, of the act, the General Assembly appropriated $200,000 to counties through which no railroad or canal was provided
at the expense of the State. This money was to be distributed proportionally based on the most recent census.
The money was to be used to improve roads, build bridges, and construct other necessary
public works. By December 1838, Johnson County had received $5,415, and Pope County $9,387.50, out of the $145,510 appropriated to counties. There appears to be some
discrepancy on the amount appropriated. Krenkel and the Sangamo Journal cite the total as $144,700, but a tabulation of the figures printed in the Sangamo
Journal results in $145,510.
