Sec.[Section] 1. Be it enacted by the People of the State of Illinois represented in the General Assembly, That so much of the Act entitled “An Act to establish and maintain a general system of Internal Improvement,” approved February 27th 1837 and all acts supplementary thereto, as authorizes as authorizes the ^further^2 prosecution of the several works therein mentioned be and the same are hereby repealed.
Sec. 2. nd No money shall hereafter be expended or appropriated, nor shall any further allowances or payments be made by any Officer of this State under the provisions of said acts to any person under any pretence whatever, unless in compliance with some law hereafter to be passed.
Sec. 3. This act shall not be construed so as to authorize any Company heretofore incorporated, or any person or persons whatever to claim or exercise any authority or control over any part of any of the works therein mentioned—or over so much of the land of individuals or companies, as may have been condemned and paid for, per the right of way, under the provisions of said Acts.

Sec. 4. The Treasurer of this State is hereby authorized to sell so much of the timber, and other articles purchased for the use of the State under said laws, as is liable to go to waste, by giving at least four weeks public notice thereof in the Paper of the Public Printer, and in some other newspaper printed nearest to the place where the said articles are to be sold.
Sec. 5. The Fund Commissioner is hereby authorized to sell the rail-road iron purchased for the use of the State if he can sell the same so as to prevent the State from losing more than thirty per cent on the cost of said iron.
Sec. 6. The Act entitled “An Act to amend an act concerning the right of way”—approved 12th Feb’y 1839—and so much of any other act of this State as authorizes any person to obtain an assessment for the right of way, on any of said works, are ^is^ hereby repealed.3

1Cyrus Edwards introduced HB 43 in the House of Representatives on December 19, 1840. On December 21, the House referred the bill to a select committee. The select committee reported back the bill on January 6 with amendments. Representatives offered amendments to the committee’s report, and on January 7 the House committed the bill and proposed amendments to the Committee of the Whole and made them the special order of the day for January 8. On January 14, the House discharged the Committee of the Whole from further consideration. On February 24, the House rejected a substitute to the original bill by a vote of 35 yeas to 37 nays, with Abraham Lincoln voting nay. The House tabled another proposed substitute by a vote of 58 yeas to 10 nays, with Lincoln voting yea. The House rejected the select committee’s amendments by a vote of 23 yeas to 45 nays, with Lincoln voting nay. The House amended the first section by adding the word “further” before the word “prosecution.” The House tabled proposed amendments to the fourth section. The House amended the sixth section by striking out all the words before “1839” and adding new language. The House ordered the bill engrossed by a vote of 53 yeas to 13 nays, with Lincoln voting yea. On February 27, the House passed the bill as amended by a vote of 51 yeas to 14 nays, with Lincoln not voting. The House reported the bill’s passage to the Senate, but the Senate took no action.
