Sec[Section] 1 Be it enacted by the people of the state of Illinois represented in the General Assembly; That the Governor shall at the present General Assembly by and with the advice and consent of the Senate appoint a public Administrator in each county in this state, who shall continue in office for four years, and until his successor is appointed, but shall before entering upon the duties of his office give a bond to the Governor in the penal sum of ten thousand dollars, with security to be approved of by the Judge of the Circuit Court or the Clerk of the Circuit court for the faithful discharge of all duties devolving on him as such public Administrator, the said bond to be filed in the office of the Circuit Court in each county.
Sec 2. The Governor shall also in the same time and manner appoint the same number of Notaries public now existing in each county, or hereafter required by law to continue in office for four years and until their successors are appointed and qualified
Sec 3 As soon as the officers aforesaid are commissioned and qualified, each of the said officers may demand of his predecessor, or present incumbent all

the books, papers[,] or writings belonging to his office, and in case of refusal to surrender the same to the appointed under this act, the officers last appointed may sue for and recover the same in an action of repleven in the name of the State of Illinois with costs of suit
Sec 4. The appointment under this act and the acceptance by the appointed shall vacate the office of the present public Administrator, or Notaries public in each county in this state, and any act or thing done by such Public Administrators, or Notaries public in his office after the appointment and qualification as aforesaid shall be null and void
Sec 5 That hereafter the circuit court of each county or the Judge thereof in vacation and by the first of September next shall appoint in each county a Master in Chancery, who shall continue in office for two years, and until his successor is appointed

1John Pearson introduced SB 38 in the Senate on December 11, 1840. On December 14, the Senate referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on January 7, 1841, recommending its passage. The Senate passed the bill on January 11 by a vote of 20 yeas to 15 nays. On February 27, the House of Representatives refused to read the bill a third time.
