Sec. [Section]1. Be it enacted by the People of the State of Illinois, represented in the General Assembly2, That so much of the public road leading from Mt. Vernon, in Jefferson county, to Brownsville, in Jackson county, as runs across the north east quarter of the south-east quarter of section thirty-one, in township two south, range three east of the third principal meridian,

be and the same is hereby changed, so as to run direct to the south-east corner of said forty acre tract; thence west, on a line with said forty acre tract, until it intersects the road, as at present laid out and travelled; and the old road, as hereby changed, is vacated:3 Provided, That such change shall not be made until the consent of the county commissioners' court of said county shall be first had: And provided further, That said court may give its consent thereto without petition being presented therefor, as is required in other cases, if they shall deem such change right and proper.

1On February 24, 1841, John Moore introduced SB 234, originally titled “A Bill in relation to the School Lands in Town Twenty-Two North, in the Senate, and the Senate referred the bill to the Committee on Counties. On February 27, the committee reported back the bill with an amendment, in which the Senate concurred. The Senate passed the bill as amended, amending the title so as to read “A Bill concerning a State Road in Jefferson County.” On February 27, the House of Representatives passed the bill. On February 27, the Council of Revision approved the bill and the act became law.

2Text on the bill indicates that on February 27, 1841, the Senate struck out the original bill text after the enacting clause and inserted in lieu thereof text related to the road in Jefferson County. This substitute became the basis for the act.
