TO THE HONORABLE,
The Congress of the United States.
The Memorial of the undersigned, a Citizen of the United States, and resident of the
City of Baltimore most respectfully represents to the Honorable the Congress of the
United States.
That during the past year (1847) under an engagement of the Owner of the Barque Mary Teresa, he became attached to that Vessel as Supercargo,—having in charge the transaction
of the business of her intended voyage, the object of which was the Sale of both Cargo
and Vessel to the best advantage in some of the Ports of Brazil.
That the business of the said Vessel was transacted honestly and lawfully, not only
in respect to the Laws of the United States, but also to those of Brazil, and prosperously
towards the Owners of the Vessel and Cargo, until the Port of Bahia was reached,
when the Consul of the United States at that place, Alexander H. Tyler, Esq., by his official power, and in his official capacity, rendered unavailable,
all the lawful exertions of the undersigned to either prosecute further the business
of the said Vessel, or to retain the control of her, in consequence of an official
charge by the said Consul, that the said Barque Mary Teresa, had become confiscated
to the Government of the United States, in consequence of her having committed an
infraction of its Navigation Laws,—for particulars, reference is respectfully made
to the case of the Owner of the Vessel, Henry Leef, of Baltimore.
That in consequence of the undersigned having been prevented from carrying out the
purpose of the voyage of the said Vessel, by the said official acts of the Consul
of the United States, at Bahia, the remuneration which he was to have had for so doing
was lost, his time was wasted by involuntary detention in a Foreign Country, attended
with heavy expenses, and he has been rendered unable to renew his usual avocation,
since his return to the United States, of all this loss an estimate is herewith furnished,
to which reference is most respectfully solicited.
The undersigned, therefore makes his Memorial, to the Honorable Congress of the United
States, and most respectfully asks for such measures for his relief, as in its wisdom
may be deemed right and proper,—and as in duty bound he will ever pray.
