Sec[Section] 1st Be it enacted by the people of the State of Illinois, Represented in the General Assembly That Benjamin Howland and Henry L Brush be and they are hereby authorized, to erect a mill dam across Fox River in Lasalle County and on the south east fractional quarter of section No one in Township No Thirty three North, of Range No Three east of the third principal Meridian
Sec. 2d Before the said Howland and Brush shall commence said Dam, they shall make an application in writing to the County Commissioners Court of Lasalle County for that purpose signifying their intention to commence said work. Where upon said
Court shall issue a warrant to the sheriff of said County commanding him to summon Twelve disinterested house holders of said County to assemble on a day to be therein named on the Tract of land above described, who
after being duly sworn by said sheriff shall procede to examine the site of said Dam, and after full and fair investigation of the premises,
shall report to said court in writing under their hands, and seals Whether in their opinion said dam can be
erected with out injury to private or public property” and the said Howland and Brush shall pay the same fees therefor as is required under Writs of Adquod Damnum
Sec 3d If their report be favorable to the erection of of said Dam they shall report as afore said which said report shall be filed and preserved among the records of said Court. The report being filed as aforesaid the said Howland and Brush shall be permitted to build a Dam as aforesaid and shall erect a lock or Slope in
said dam so as not to obstruct the navigation of said stream

1John T. Stuart from the Committee on Petitions, to which the House of Representatives referred the petitions of Benjamin Howland and Henry L. Brush, introduced HB 124 in the House on January 17, 1835. The House passed the bill on
January 20. On January 21, the Senate referred the bill to the Committee on Internal Improvements. The Committee on Internal
Improvements reported back the bill on January 23 without amendment, recommending
its rejection. The Senate refused to read the bill a third time.
