AN ACT for the relief of the widow and heirs of Christopher Whitman.

Martha Whitman authorised to sell certain land.
Sec.[Section] 1. Be it enacted by the people of the State of Illinois represented in the General Assembly, That Martha Whitman executrix of the last will and testament of Christopher Whitman, deceased, be and she is hereby authorised to sell the following described lots of land, formerly owned by said Christopher Whitman, and situate in the county of Macon, and designated on the plat of the United States survey, as the west half of the north east quarter of section eight, in township sixteen north of range three east of the third principal meridian;2 also of the east half of the south west quarter of section five, in the same range and township, said lots of land shall be sold for cash, or on such credit as the judge of probate of Macon county may direct, and on the payment of the purchase money for the same, the said Martha Whitman is hereby authorised to make and execute good sufficient deeds therefor to the purchaser, which deeds shall convey all the right, title, and interest of the said Martha Whitman, and the heirs of said Christopher Whitman, in the land aforesaid, to said purchaser; Provided however, that before the sale of the land above described, said Martha Whitman shall enter into bond with good security in such sum of money as the judge of probate of Macon county may direct, conditioned for the faithful performance of the duties imposed upon her by this act, which bond shall be filed in the office of the judge of probate of Macon county.

Sec. 2. It shall be the duty of said Martha Whitman to invest the money which may arise from the sale of the land above described, in other land, for the benefit and in the name of herself and the heirs of said Christopher Whitman deceased, and for no other purpose whatever.3
This act to be in force from and after its passage.

at the end of the last session of the General Assembly as not acted upon for the want of time, and not having been laid before the Legislature on the first day of the present session, it has become a law the 8th day of December, 1835.

1On January 24, 1835, Peter Butler of the House of Representatives presented the petition of sundry citizens of Warren County on behalf of Martha Whitman. The House referred the petition to the Committee on Petitions. John T. Stuart from the Committee on Petitions introduced HB 160 in the House on January 27. The House referred it to a select committee. The select committee reported back the bill on January 29 with an amendment, in which the House concurred. The House passed the bill as amended on January 31. The Senate concurred on February 2. The House and Senate laid the bill before the Council of Revision on February 6, but the Council returned it without action on February 13, the last day of the session, citing want of time. Legislators having not laid said bill before the General Assembly on the first day of the second session, the act became law on December 8.
