An act to sum locate a state ^road^2 from Frankfort in Franklin County in this state, to New Nashville in Washington County
Sec[Section] 1 Be it enacted by the people of the state of Illinois represented in the General Assembly, That Benjamin Johnson Good of Franklin County[,] John Bland of Perry County[,] and William Stuart of Washington County be, and they are hereby appointed Commissioners to survey and mark a road from Frankfort in Franklin County in this state to New Nashville in Washington County.
Sec 2 said Commissioners or a majority of them shall, [?] or before the first Monday in April next mee[t] at Frankfort in the month of April next and after being duly sworn before some justice of the
peace faithfully to discharge the duties required of them by this act, shall proceed
to view, mark[,] and locate said road, taking into consideration the local situation of the country
and the public convenience, and shall fix said road on the most advantageous ground
for a permanent road through the north east corner of Perry county
Sec 2. said Commissioners, shall on or before the first Monday of April
^June^ next make report of their proceedings to the county Commissioners of the respective
Counties through which said road may pass, and said Road when thus laid out, shall
be a public high way of this state, and the County Commissioners Courts of each and every County through which said road may pass, shall cause the same to
be opened and kept in repair as other public ^roads^ are. said commissioners shall receive for their services ^a just compensation^ out of the funds of the Counties respectively, in which they reside

by order of the Commissioner Courts. Provided that the County roads in the Counties of Franklin and Washington Counties ^as now^ laid out and kept in repair by order
in said Counties leading from the county seat of each to the other shall be parts
of the said state road herein authorized to be opened, and that the said [r]oad when so viewed, marked[,] surveyed[,] and located shall be and is hereby declared a state road, to be opened four poles
wide, and kept in repair as other state roads ar[e]

1Braxton Parrish introduced SB 42 in the Senate on December 22, 1835. The Senate passed the bill on January 4, 1836. On January 7,
the House of Representatives referred the bill to a select committee, and the select committee took no further
action.

2State roads were those public roads established or designated by the General Assembly and usually crossed county lines. Only the General Assembly could establish, alter,
or abandon state roads, until 1840 and 1841, when the General Assembly gave counties
the authority to alter or to abandon state roads upon petition by a majority of voters
in the area of the change.
