Mr. Canedy was chosen President pro tem.
A communication from the Hon. S. H. Treat, resigning his office as Trustee, was laid before the Board.
On motion,
Resolved, That while we acquiesce in the propriety of the resignation of the Hon. S. H. Treat, rendered necessary to the appointment to the Judiciary, we cannot but regret to part with a member of our Board, whose devotion to the interests of our town, and whose cordial support of the measures adopted by the Board for its benefit, we so well appreciate, and readily acknowledge.
On motion,
Resolved, That A. Lincoln, Esq.[Esquire] be appointed Trustee, in place of S. H. Treat, resigned.
Wm. Butler, Esq. administered the oath of office to A. Lincoln, Esq. after which Mr. Lincoln took his seat with the Board.
Mr. Kleine, from the committee on that subject made a report on the cost of paving, and grading the side walk on the south side of the public square. Report accepted.
Mr. Kleine, from the committee on that subject, made a report respecting the improvement of a certain alley.
On motion, Resolved, That said Report be accepted, and that the Street Commissioner be directed to remove the nuisances in said alley in the manner presented by the 9th section of the ordinance, passed January 19, 1836.
J. Plank presented his bill, for two dollars for services as Judge at the late Election. Allowed. (Order issued 29th June, 1839.)
On motion, Resolved, That H. M. Armstrong, B. S. Clement, A. R. Robinson and I. S. Britton, judges and clerks of the late election, be allowed two dollars each for their services. (orders issued to Armstrong and Britton, 19th Sept. 1839—given to Higby.)

E. D. Baker presented his bill in full for services as Attorney of the Corporation, of twenty-five dollars. Allowed. (order issued June 24, 1839.)
E. D. Baker resigned his office as Attorney of the Corporation.
The petition of M. Helm and others, asking the Trustees to cause the drain now passing through the Block south of the public square, to be re directed, that it may no longer run beneath certain houses.
Referred to a committee, consisting of Mr. Canedy and Lincoln. Adjourned.
