AN ACT to locate a state road from Nashville in Washington county, to Equality in Gallatin county.

Commissioners appointed to locate said road
Sec.[Section] 1. Be it enacted by the people of the State of Illinois, represented in the General Assembly, That Downing Baugh of Jefferson county, Thomas Thompson of Franklin county, George W. Lee of Washington county, and George M’Crary of Gallatin county, be and they are hereby appointed commissioners to view, locate, and mark a state road2 leading from Nashville in Washington county, via Portland in Franklin county, to intersect the road from Frankfort to Equality at Galatia, thence to Equality in Gallatin county.3
When and where to meet

Sec. 2. The said commissioners or a majority of them shall meet at Nashville on the first day of April next, or as soon thereafter as practicable, and after being duly sworn shall proceed to view, mark, and locate said road on the nearest route, and best ground, on a straight direction as nearly as the nature of the country will admit.

Sec. 3. The said commissioners shall, as soon as convenient after the location of said road, cause to be filed with the clerks of the county commissioners courts of the coun-

ties through which said road passes, a report and complete map of said road, which report and map shall be preserved and shall form a part of the records of said court: said road when so established, shall be opened and kept in repair as other state roads are.
Compensation
Sec. 4. The county commissioners of the counties through which said road passes, shall allow to said road commissioners such compensation, not exceeding two dollars per day, as to them shall seem just and reasonable, and said compensation to the above named commissioners shall be paid by the respective counties, in proportion to the time said commissioners may necessarily be employed in each county while locating said road, when the commissioners shall have filed a copy of the report as is recited in this act, duly certified and attested by them.4

1On January 21, 1837, John D. Wood in the Senate introduced the petition of the citizens of Washington County, requesting a state road from Nashville to Equality. The Senate referred the petition to a select committee. In response to this petition, Wood of the select committee introduced SB 110 in the Senate on January 23 . On January 25, the Senate passed the bill. On January 27, the House of Representatives referred the bill to a select committee. The select committee reported back the bill on February 3 with several amendments, in which the House concurred. On February 8, the House passed the bill as amended. On February 22, the Senate concurred in the House amendments. On February 24, the Council of Revision approved the bill, and the act became law.

2State roads were those public roads established or designated by the General Assembly and usually crossed county lines. Only the General Assembly could establish, alter, or abandon state roads, until 1840 and 1841, when the General Assembly gave counties the authority to alter or to abandon state roads upon petition by a majority of voters in the area of the change.
