AN ACT to revive and continue in force “An act authorizing a re-view of a part of the Vincennes and Chicago Road.”

Act revived.
Sec.[Section] 1. Be it enacted by the people of the State of Illinois, represented in the General Assembly, That the act, entitled “An act authorizing a re-view and re-location of a part of the State road from Vincennes to Chicago,” approved, February 28th, 1833,2 be, and the same is hereby revived and continued in force for two years from and after the passage of this act.
Sec. 2. The commissioners in said act named, to which this is an amendment, may, at any time within three months from the passage hereof, take the oath prescribed by said

act, and enter upon and perform the duties in said recited act: Provided, the acts of a majority thereof shall be a sufficient compliance with said act to all intents and purposes, as is by the said act contemplated, as fully to every intent and purpose as if done originally within the time named therein.
This act to be in force from and after its passage.

1On January 15, 1835, Lunsford R. Noel of the Senate introduced a remonstrance from sundry citizens of Clark and Edgar counties against a proposed change in of a state road from Darwin to Paris. The Senate referred the remonstrance to a select committee. George W. P. Maxwell from the select committee introduced SB 61 in the Senate on January 19. The Senate passed it on January 27. On January 28, the House of Representatives referred the bill to a select committee. The select committee reported back the bill on January 30 with an amendment, in which the House concurred. The House passed the bill as amended on February 2. The Senate concurred in the House amendment on February 3. On February 6, the Council of Revision approved the bill and the act became law.

2The 1833 act empowered the commissioners to review that part of the road lying between Aurora and the southern boundary of Edgar County, with a view to changing the route to pass through Livingston.

3On January 19, 1835, the Senate select committee, to which the Senate referred the remonstrance from sundry citizens of Clark and Edgar counties, submitted a report along with SB 61.The select committee reported that the people from Edgar County were averse to any change of the road through Edgar County, while citizens of Clark County supported the change. The select committee supposed the General Assembly passed the act of February 28, 1833, to meet the views and interests of both counties. Accordingly, the 1833 act proposed changing the road through Clark County, but terminating the change when the road crossed the line between the two counties. Viewing this as the most equitable solution and believing that the 1833 legislation was no longer in force, the select committee proposed SB 61 to revive the previous act.
