Sec.[Section] 1st Be it enacted by the People of the State of Illinois represented in the General Assembly, That John Mckinney of Warren County and Martin Shewey of Adams County, and James Welch of Hancock county be and they are hereby appointed commissioners to view[,] mark[,] and Locate a state road Leading from Monmoth in Warren County by way of Franklin in Hancock County to the Town of Carthage in Said Last Mentioned County.
Sec. 2. The commissioners aforesaid or any two of them shall on the first Monday of March next or within six months thereafter meet at the town of carthage aforesaid and after being sworn by some Justice of the peace in, and for the county of Hancock faithfully and impartially to perform such duties as are required of them by this act, shall proceede to the place of beginning, and commence the Location of said road, and as soon as practicable shall make a true survey, and correct map thereof signed by them and file the same in the office of the county commissioners courts of the several counties through which the road passes, Thence the nearest and best rout to intersect the road Leading from Quincy To McComb at or near the town of Fairfield in Adams County.
Sec. 3. Said road when Laid out shall be deemed a Public highway. The county commissioners of said Count[ies] shall cause the said road to be opened four poles wide and be worked and kept in repair as other state road are. the county commissioners of said Counties may allow a reasonable compensation in proportion to the distance which said road may run in each county, for said services to be paid out of the county treasuries of said counties.2
Sec 4 That John G Sanburn of Knox County, Asa Crook of Henry County and James Craig of Jo Davies County are appointed to view mark[,] survey[,] and locate a road from Knoxville via Henryville3 to Galena by the nearest and most eligible route having in view the highest and

most suitable ground for the location thereof, doing as little damage to private property as the public good will permit
Sec 5 The said Commissioners or a majority of them, shall meet at the Town of Knoxville on some day after the first Monday in April and after being duly sworn by some justice of the peace, faithfully to discharge the duties required by this act, shall proceed to view and locate said road without partiality, and as soon as practicable after said road is located said commissioners, or a majority of them shall make out a report accompanied by a map of said road, noting the courses and distances from point to point with such remarks as they may deem necessary, and transmit the same to each of the Clerks of the County Commissioners’ Courts of Knox and Jo Davies to be by them filed and preserved in their offices respectively
Sec 6. When said road shall be located, it shall be a State road and shall be opened and kept in repair as other state roads and the county commissioners of Knox and Jo Davies Counties shall allow said Commissioners a reasonable compensation for their services, to be paid out of their County treasuries respectively

1Peter Butler introduced HB 63, originally titled “A Bill to Locate a State Road from Monmouth in Warren County, to Carthage in Hancock County,” in the House of Representatives on December 23, 1835. On December 30, the House referred it to a select committee. The select committee reported back the bill on January 2, 1836, with an amendment, in which the House concurred. On January 4, the House referred the bill to a select committee. The select committee reported back the bill on January 6 with an amendment, in which the House concurred. The House passed the bill as amended, amending the title so as to read, “A Bill to locate state roads from Monmouth in Warren county, to Fairfield in Adams County, and from Knoxville to Galena.” The Senate took no action.
