An Act for the benefit of the Counties therein named:

Sec[Section]. 1. Be it enacted by the people of the State of Illinois represented in the General Assembly That in addition to the counties receiving a distributive share of the two hundred thousand dollars Appropriated by the fifteenth direction of the eighteenth Section of the act entitled, to “An Act Act to establish and maintain a General System of Internal Improvement:” Approved 27^th Feb[February]. 1837.”; the counties of Stephenson, Winnebago, Boone, Henry, M^cHenry, Kane, De Kalb, Cass and such other counties as shall be formed during the present session, through which no rail road or canal, to be made at the expense of the state shall pass, shall receive out of the forty nine thousand, six hundred and thirty two dollars and fifty cents, retained by the fund commissioners, each fifteen hundred dollars.

Sec. 2. That the fund Commissioners be, and they are hereby ordered and required to pay over to the aforesaid counties respectively, the sums above

named; And that the remainder of the undivided balance in their hands be distributed among all the counties heretofore, and by this act, entitled to a distributive share of the moneys aforesaid, according to the vote given at the August Election of 1838.

Sec. 3. That said moneys shall be applied by the commissioners’ courts of the respective counties: First, to the building of the necessary bridges and the making of other improvements on the state roads within their counties: and secondly; the balance, if any any there be, to the building of bridges and otherwise improving the county roads of their respective counties.

Sec. 4. Be it further enacted, that if any county in this state has heretofore received, or shall by this act receive a distributive share dividend of the two hundred thousand dollars, aforesaid, through which any rail road or Canal, to be made at the expense or cost of the State, is located, or shall hereafter be located, then

and in that case the county or counties so having received a dividend as aforesaid shall refund such dividend to the fund commissioners within twelve months after the commissioners shall make a requisition upon the County Commissioners therefor. And the dividends when so refunded, shall be divided by the fund commissioners among, and paid over to, the counties entitled to a distributive share of the said two hundred thousand dollars, in the proportion as is directed in the second second section of this act.
