AN ACT to locate a state road from Vandalia to Alton.

Commissioners appointed to view road from Vandalia, crossing west fork of Wood river, cross to Upper Alton, then to Lower Alton.
Sec.[Section] 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That Peter Merrill and Joseph Burnap, of Madison county, and James M. Davis, of Bond county, and Robert K. McLaughlin, of Fayette county be, and they are hereby appointed commissioners to view, mark, and lay out a State road,2 four rods wide, from Vandalia, in Fayette county; thence on the nearest and best ground through Bond county, crossing the west fork of Wood river at the point where the Springfield and Alton State road now crosses to Upper Alton; and thence to the Mississippi river at Lower Alton, in Madison county, doing as little injury to private property as a due regard to the public good will permit.3

Sec. 2. That said commissioners, or a majority of them, shall meet at Vandalia on the second Tuesday in March next, or within sixty days thereafter, and after being duly sworn before some justice of the peace, or clerk of the circuit court, well and truly to perform the duties required of them by this act, according to the best of their skill and ability, shall proceed to view, mark, and lay out said road, agreeably to the provisions of the first section of this act.
Commissioners to report a map and survey to clerks of Fayette, Bond and Madison counties, to be laid before county com’rs.
Declared a public road.

Sec. 3. That as soon as said road may be located the said commissioners shall make out a complete map or plat of said road, so viewed, marked, and located by them; they shall certify to the same, and deposite in the office of the county clerks of the counties of Fayette, Bond and Madison plats of so much of said road as may lie in those counties, and the clerks of said counties shall cause said plat or survey to be laid before the county commissioners courts of each of the aforesaid counties at the first session of said courts, after the plat shall be filed in the office of the clerk and the said commissioners shall cause an entry thereof to be made on their records, and the said road so located, is hereby declared a public road, and the county commissioners of said counties shall cause the same to be opened at least three rods wide and kept in repair in the same manner as other public roads are required to be by law.
Compensation
Sec. 4. Each of said commissioners, markers and chain carriers shall receive such compensation for their services out of their respective county treasuries as their respective county commissioners courts may order and allow.4
Repealing clause.
Sec. 5. Any State road heretofore located from Vandalia to Alton is hereby vacated.

The foregoing bill having remained with the council of revision ten days, (Sunday excepted) and the general assembly being in session, it has become a law, this 10th February 1837.

1John Hogan introduced HB 29 in the House of Representatives on December 23, 1836. On January 9, 1837, the House referred the bill to a select committee. The select committee reported back the bill on January 13 with various amendments, in which the House concurred. The House passed the bill as amended. The Senate concurred on January 16. The House and Senate having laid the bill before the Council of Revision on January 21, and the bill remaining with the Council ten days while the General Assembly was in session, the bill became law on February 10.

2State roads were those public roads established or designated by the General Assembly and usually crossed county lines. Only the General Assembly could establish, alter, or abandon state roads, until 1840 and 1841, when the General Assembly gave counties the authority to alter or to abandon state roads upon petition by a majority of voters in the area of the change.
3On January 13, 1837, the House of Representatives amended the bill by adding Merrill and Burnap as commissioners, replacing Nimrod Dorsey and Gersham Flagg, and by changing some of the points of contact.
